“Golden Element” Official Rules

1. Eligibility

The Hoefer Inc. Golden Element Promotion ("Promotion") is open only to legal residents of the United States who are at least eighteen (18) years old at the time of entry. Employees of Hoefer Inc., its affiliates, subsidiaries, advertising and promotion agencies, and suppliers (collectively the "Employees"), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Promotion. The Promotion is void where prohibited by law.

2. Promotion Period

The Promotion begins on September 1, 2024, at 12:00 AM ET and ends on November 30, 2024, at 11:59 PM ET ("Promotion Period").

3. How to Enter

  • Automatic Entry: Customers who make a purchase on Hoefer Inc.'s website or from a participating Hoefer distributor during the Promotion Period will be automatically entered and have the chance to receive a Golden Element card with their order.
  • Extra Entry: To receive an extra entry, participants must follow Hoefer Inc. on LinkedIn and tag Hoefer Inc. in a post.
  • No Purchase Necessary: To enter without making a purchase, follow and tag Hoefer Inc. in a post on LinkedIn: https://www.linkedin.com/company/hoefer-inc/                                                            All LinkedIn entries must be posted by the end of the Promotion Period. This does not guarantee a Golden Element card but will enter the participant into the drawing. Participants will be contacted directly through LinkedIn if they are selected.

4. Golden Element Card Redemption

Recipients of a Golden Element card must follow the instructions on the card to redeem their prize. Each card will contain instructions for claiming the prize.

5. Prizes

Prizes include:

  • Grand Prize: $500 travel voucher for airline of choice
  • Cash Prizes: $100 cash prizes
  • Hoefer Branded Items: Hoefer branded merchandise

6. Prize Redemption

To redeem a prize, follow the instructions on the Golden Element card. All claims must be made by December 31, 2024. Failure to claim a prize by this date will result in forfeiture of the prize. Winners may be required to sign an affidavit of eligibility and a liability/publicity release.

7. Odds of Winning

The odds of winning depend on the number of eligible entries received during the Promotion Period. There will be 1 winner for the Grand Prize, 3 winners for the Cash Prizes, and 12 winners for the Hoefer Merchandise. For example, if 100 eligible entries are received, the odds of winning are as follows:

  • Grand Prize: 1 in 100
  • Cash Prizes: 3 in 100
  • Hoefer Merchandise: 12 in 100

 8. Taxes

All federal, state, and local taxes on prizes are the sole responsibility of the winners.

9. General Conditions

  • Hoefer Inc. reserves the right to cancel, suspend, and/or modify the Promotion, or any part of it, if any fraud, technical failures, or any other factor beyond Hoefer Inc.’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Hoefer Inc. in its sole discretion.
  • Hoefer Inc. reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner.
  • Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Hoefer Inc. reserves the right to seek damages from any such person to the fullest extent permitted by law.

10. Limitations of Liability

By entering, you agree to release and hold harmless Hoefer Inc. and its subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize.

11. Disputes

Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Massachusetts. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Hoefer Inc. in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of Massachusetts, without giving effect to any choice of law or conflict of law rules (whether of Massachusetts or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Massachusetts.

12. Privacy

Information collected from participants is subject to Hoefer Inc.'s privacy policy.

13. Winners List

For a winners list, please send a self-addressed, stamped envelope to: Hoefer Inc. Golden Element Promotion, 32 Scotland Blvd, Ste 9, Bridgewater, Massachusetts 02324, United States of America. Requests must be received by January 31, 2025.
